These Terms of Service govern access to and use of www.gatittostore.com, including all information, content, functions, tools, products and services made available through the website.

They also apply to purchases completed and paid for directly through the Gatitto Store online checkout.

By accessing the website, creating an account or placing an order, you confirm that you have read and agree to these Terms of Service and the other policies published on the website.

If you do not agree with these terms, you should not use the website or its services.

The website is operated using Shopify’s e-commerce technology.

1. Trader information

2. Scope of these terms

These terms apply to:

  • visitors to the website;
  • registered customers;
  • purchases made directly through the website;
  • use of the basket and checkout;
  • product reviews and user content;
  • communications with Customer Support;
  • returns, cancellations and refunds related to direct purchases.

Where a customer follows a link to an external marketplace or website and completes payment there, the external seller’s terms and policies will apply to that transaction.

3. Eligibility and lawful use

By using the website, you confirm that you have the legal capacity to enter into a contract under the law applicable to you.

Where a customer is under the age of legal capacity, an order must be placed with the involvement or authorisation of a parent or legal guardian.

8. Prices and currency

Unless otherwise stated, prices displayed on the website are shown in euros (€).

Before placing an order, the customer will be shown, as applicable:

  • discounts;
  • VAT or other taxes;
  • delivery charges;
  • other unavoidable charges known at that time;
  • the total amount payable.

Prices may change for future purchases without prior notice.

A price change will not affect an order that has already been validly accepted.

9. VAT, customs duties and import charges

A customer should not be charged undisclosed mandatory costs after placing the order.

10. Pricing errors

If we identify a material and obvious pricing or product-information error, we may contact the customer before dispatch.

The matter will be assessed taking into account:

  • the nature of the error;
  • how obvious it was;
  • the usual market price;
  • the customer’s reasonable expectations;
  • good faith;
  • applicable consumer law.

An error does not give Gatitto Store an unrestricted right to cancel a valid order.

If an order is cancelled after payment because it cannot legally or reasonably be fulfilled, the amount paid will be refunded.

11. Promotions and discount codes

Gatitto Store may offer:

  • discount codes;
  • temporary promotions;
  • free delivery;
  • gifts;
  • bundle offers;
  • limited-stock campaigns.

Unless otherwise stated:

  • offers apply only during the advertised period;
  • offers may be restricted to selected products or countries;
  • discount codes may not be combined;
  • a minimum order value may apply;
  • an offer may be limited to one use per customer;
  • availability may be limited.

We may correct or withdraw a promotion for future orders where there is an obvious error, misuse or fraud.

A promotion already validly applied to an accepted order will not be withdrawn arbitrarily.

12. Placing an order

  3. provide billing and delivery information;

13. Order acknowledgement and acceptance

An acknowledgement email does not necessarily mean that the order has been finally accepted where payment, stock, fraud or compliance checks remain outstanding.

A sales contract is concluded when Gatitto Store:

  • accepts the payment; and
  • communicates acceptance or dispatch, according to the checkout process used.

The order confirmation should contain or provide access to:

  • the total price;
  • billing and delivery details;
  • the selected delivery method;
  • the estimated delivery period;

  • the applicable contractual terms.

14. Refusal or cancellation of an order

An order may be refused or cancelled where there is a legitimate reason, including:

  • payment refusal;
  • suspected fraud;
  • unauthorised use of a payment method;
  • definitive stock unavailability;
  • a legal restriction;
  • an inability to deliver;
  • a material and obvious error;
  • serious misuse of a promotion;
  • a breach of these terms.

Where payment has already been received, any amount due will be refunded through the original payment method wherever reasonably possible.

15. Payment methods

The available payment methods will be displayed during checkout and may include:

  • Visa;
  • Mastercard;
  • American Express;
  • PayPal;
  • Apple Pay;
  • Google Pay;
  • Shop Pay;
  • other payment methods supported through Shopify or its payment partners.

The mention of a payment method in these terms does not guarantee that it is available for every customer, country or transaction.

Payment services are provided by specialised third parties.

Gatitto Store does not normally receive or store complete card numbers or card-security codes.

16. Payment authorisation and fraud checks

A transaction may be:

  • approved;
  • declined;
  • held for review;
  • subjected to additional verification;
  • cancelled for security reasons.

We or our payment providers may request reasonable additional information where:

  • billing details do not match;
  • there is unusual transaction activity;
  • the transaction is flagged by fraud-prevention systems;
  • identity or payment authorisation requires verification.

An order will not normally be processed until payment is confirmed.

17. Shipping and delivery

Orders will be delivered to the address provided during checkout.

Estimated delivery periods will be displayed before the order is submitted or otherwise provided in the order information.

Delivery may be affected by:

  • customs procedures;
  • carrier delays;
  • weather conditions;
  • public holidays;
  • local delivery restrictions;
  • incorrect address details;
  • exceptional operational circumstances.

18. Delivery obligations

Gatitto Store remains responsible for dealing with delivery issues relating to an order purchased directly through its website, even where delivery is carried out by:

  • a supplier;
  • a fulfilment centre;
  • a postal operator;
  • a courier;
  • another logistics provider.

A general exclusion of responsibility for all carrier delays or losses will not apply where it would conflict with mandatory consumer law.

19. Delivery risk

For consumer sales, the risk of loss or damage generally remains with the trader until the customer, or a third party nominated by the customer, physically receives the goods.

This may differ where the customer independently appoints a carrier that was not offered by Gatitto Store.

20. Incorrect or incomplete delivery address

Customers must provide a complete and accurate delivery address.

If an error is identified before dispatch, the customer should contact us immediately.

After dispatch, changing the address may not be possible.

Where a parcel is returned solely because of inaccurate information supplied by the customer, reasonable additional delivery costs may be charged, provided:

  • the cause is verified;
  • the cost is disclosed in advance;
  • the charge is lawful and proportionate.

No additional charge will apply where the error was caused by Gatitto Store, its supplier or its carrier.

21. Separate shipments

Products from one order may be shipped separately where they are supplied from different warehouses or suppliers.

In that case:

  • products may arrive on different dates;
  • different carriers may be used;
  • more than one tracking number may be issued;
  • receipt of only part of the order does not necessarily mean that another item is missing.

22. Delayed or missing orders

If an order is materially delayed or does not arrive, the customer should contact:

An investigation must be conducted within a reasonable period and will not be used to postpone a legally required remedy indefinitely.

Where delivery becomes impossible, or the trader fails to deliver within the applicable contractual or statutory period, the customer may be entitled to:

  • require delivery;
  • set an appropriate additional deadline;
  • cancel the contract;
  • receive a refund;
  • use another remedy available under national law.

23. Product inspection

Customers should inspect products within a reasonable time after delivery.

If a product is:

  • damaged;
  • defective;
  • incomplete;
  • different from the order;
  • not as described;
  • otherwise not in conformity;

The absence of photographs will not automatically remove statutory consumer rights.

24. Right of withdrawal for EU consumers

Consumers in the European Union generally have the right to withdraw from an online purchase within 14 calendar days, without giving a reason.

For goods, the period generally begins when the consumer, or a nominated third party, receives the goods.

To exercise the right, the customer must send a clear withdrawal statement before the deadline to:

The customer must then return the goods without undue delay and generally no later than 14 days after communicating the withdrawal.

25. Effects of withdrawal

Where a valid EU withdrawal right is exercised, Gatitto Store will refund:

  • the price paid for the returned goods; and
  • the cost of the least expensive standard delivery method offered.

Additional delivery costs resulting from the customer choosing a more expensive method do not normally have to be refunded.

The customer may be responsible for the direct return cost where this was clearly disclosed before purchase and applicable law permits it.

The refund may be withheld until:

  • the returned goods are received; or
  • the customer provides evidence that they were sent back,

whichever occurs first.

26. Withdrawal exceptions

The statutory withdrawal right may not apply to certain contracts permitted by law, including:

  • personalised or custom-made goods;
  • goods that deteriorate or expire rapidly;
  • sealed hygiene or health-protection goods after the seal is broken;
  • sealed audio, video or software after unsealing;
  • goods inseparably mixed with other goods after delivery;
  • certain digital content supplied immediately after the required consent and acknowledgement;
  • other legally recognised exceptions.

An exception from change-of-mind cancellation does not remove rights concerning faulty, damaged or non-conforming products.

27. Voluntary return policy

Where Gatitto Store offers a voluntary return period longer than the statutory 14-day period, the additional commercial conditions will be described in the Returns and Refund Policy.

Any voluntary policy:

  • supplements mandatory consumer rights;
  • does not replace the statutory withdrawal right;
  • does not shorten the legal conformity guarantee;
  • may contain reasonable conditions for change-of-mind returns outside the statutory period.

28. Legal guarantee and conformity

EU consumers have a minimum two-year legal guarantee from delivery for goods that are defective, do not match their description or otherwise fail to conform to the contract. Some national laws provide longer protection.

The legal guarantee is provided by the seller and is separate from any optional commercial or manufacturer warranty.

A commercial warranty cannot reduce statutory rights.

29. Remedies for non-conforming products

Where goods are not in conformity, the consumer may be entitled to remedies such as:

  • repair;
  • replacement;
  • price reduction;
  • termination of the contract;
  • full or partial refund.

Repair or replacement must generally be provided:

  • free of charge;
  • within a reasonable time;

30. Returns, exchanges and refunds

All return, exchange and refund requests are governed by the Returns and Refund Policy.

A customer will not be required to accept:

  • a different product;
  • a replacement;

where applicable law gives the customer the right to a monetary refund.

Internal inspection or approval procedures will not be used to restrict mandatory consumer rights.

  • refunds must normally be requested from the party that processed the payment.

Gatitto Store may not have operational access to cancel or refund a transaction completed directly with a third party.

40. Indirect or consequential losses

For consumers, no exclusion of indirect or consequential loss will apply where such exclusion would be unfair or contrary to mandatory national law.

Gatitto Store does not exclude liability for losses that were reasonably foreseeable when the contract was concluded and directly resulted from a breach for which Gatitto Store is legally responsible.

41. Force majeure and exceptional events

This section does not remove the customer’s mandatory right to cancel or receive a refund where applicable.

Changes will not be used to retroactively reduce rights relating to an accepted order.

The affected provision will be interpreted or adjusted only to the extent necessary to make it lawful and enforceable.

48. No waiver

A delay or failure to exercise a right does not amount to a waiver of that right.

A waiver will apply only where it is clearly and validly communicated.
